Our Terms and Conditions of Sale govern all transactions for the provision of goods or services supplied by Erntec.

- Definitions:
- The terms used in the document have specific meanings, including "Goods," "Customer," "Company," and others.
- Application:
- These Terms apply to all Goods sold by the Company. No alterations are binding without written confirmation from the Company.
- Terms of Payment:
- Prices are ex-store and subject to change without notice. For credit accounts, unless otherwise agreed payments are to be made within thirty (30) days of the invoice date.
- Property in Goods and Insurance:
- Goods remain the property of the Company until full payment is received. The Customer must insure and maintain the Goods until ownership transfers.
- Personal Property Securities Act:
- The PPSA applies to these Terms, and the Company holds a Purchase Money Security Interest in the Goods until payment is received.
- Re-Sale of Goods:
- If the Customer is a re-seller, they can sell the Goods at full market value, subject to certain conditions.
- Default:
- The Company may terminate the contract in case of non-payment or events that affect the Customer's ability to pay.
- Company's Liability Limited:
- The Company's liability is limited, and it is not responsible for indirect or consequential losses.
- Warranty:
- The Company warrants that Goods are free from defects in materials and workmanship at the time of supply.
- Delivery:
- The risk of Goods passes to the Customer upon leaving the Company's premises.
- Return of Goods:
- Returns must be agreed upon in writing, and the Goods must be in resalable condition.

- Cancellation of Order:
- Order cancellations require prior written consent and may incur a cancellation and restocking fee.
- Company's Liability as Trustee:
- If the Customer is a trustee, certain obligations and warranties apply.
- Goods and Services Tax:
- GST is not included in the quoted price.
- Customs Duties, Tariffs, and Levies:
- Unless otherwise indicated, the Customer is responsible for all applicable duties and levies.
- Inspection and Acceptance:
- The Customer must inspect the Goods and notify the Company of any defects within fourteen (30) days.
- Delivery by Instalments:
- The Company may deliver Goods in instalments.
- Samples and Specifications:
- Samples are for convenience and do not constitute a sale by sample.
- Contract:
- The agreement is contained in these Terms and any other signed written agreement between the parties.
- Force Majeure:
- The Company is not liable for breaches due to matters beyond its control.
- Waiver of Breach:
- Failure to insist on strict performance does not waive the Company's rights.
- No Assignment:
- The Customer cannot assign the Agreement without the Company's written consent.
- Severability:
- If any provision is found invalid, the rest remain unaffected.
Warranty

- ERNTEC Pty Ltd (ERNTEC) provides a warranty for its goods sold to the Purchaser.
- The warranty covers defects in material and workmanship for one year from the delivery date.
- If the goods are found to be defective within this period, ERNTEC will either replace the goods or reimburse the purchase price, subject to certain conditions.
- The warranty does not cover defects caused by misuse, unauthorized modifications, or improper maintenance.
- ERNTEC's liability is limited to the cost of replacement or repair, and it will not be liable for any special or indirect losses incurred by the Purchaser.
- If the Purchaser resells the goods to a consumer, ERNTEC's liability is subject to the Trade Practices Act.
- The warranty applies to specific goods as described in the Schedule and is subject to certain application limitations.
